How to Enter: The Jump Into Spring Sweepstakes (the “Sweepstakes”) will begin on March 14, 2024 at 10AM CST and will end on March 20, 2024 at 12AM CST (the “Sweepstakes Period”). You must have a valid, public Instagram account. If you follow “@drinkreddiamond” on Instagram, like the post, and comment on the post posted on March 14, 2024 during the Sweepstakes Period, you will be automatically entered into the Sweepstakes. Alternatively, you may enter the Sweepstakes by calling 205-577-4010 and providing your name, home address, phone number and date of birth by the end of the Sweepstakes Period. Any attempt to enter the Sweepstakes by any other methods is void. Only eligible entries actually received by Sponsor (as defined below) before the end of the Sweepstakes Period will be included in the prize drawing. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Limit 1 entry per person over the Sweepstakes Period. In case of dispute as to identity of participant, entry will be declared made by the authorized account holder of the social media account or telephone account used to submit the entry. “Authorized Account Holder” is defined as the natural person who is assigned the account by the social media provider, telephone company or other relevant organization. Any other attempted form of entry is prohibited; no automatic, programmed;\, robotic or similar means of entry are permitted.
Prizes: Grand Prize: One entrant will be selected to receive coupons for a three-month supply of Red Diamond ready-to-drink tea (12 coupons, each for one gallon of tea for a combined value of $36.00), two Red Diamond tumblers (combined value of $30.00), and two Red Diamond embroidered vintage washed caps (combined value of $33.00). No entrant will be awarded more than one prize. Prizes cannot be transferred or assigned. Income and other taxes on each prize are the sole responsibility of the winner. Red Diamond reserves the right to substitute a prize of equal or greater value if any advertised prize becomes unavailable. Red Diamond expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prize(s) awarded. Red Diamond makes no representation or warranties concerning the appearance, safety or performance of any prize awarded.
Who Is Eligible? This Sweepstakes is open to legal residents of the United States and the District of Columbia, except where prohibited by law or excluded by these Official Rules: who (a) are 18 years of age or older or have reached the age of majority in their jurisdiction of residence at the time of entry, whichever is greater; and (b) are legally able to work in the United States. Residents of the following states are excluded from participation in this Sweepstakes: Arizona, Florida, New York, Tennessee and Vermont. Employees of Red Diamond and members of their immediate families or households are not eligible.
How Is the Winner Selected and Notified? The winner will be chosen by a random drawing to be held on March 21, 2024 by Red Diamond from all eligible entries received during the Sweepstakes Period. The winner need not be present to win. All decisions by Red Diamond concerning the Sweepstakes are final. Actual odds of winning depend on the total number of eligible entries. The winner will be notified on or after March 21, 2024. A winner entering through social media will be notified via direct message. If unable to make contact with the potential winner within forty-eight (48) hours, he/she will be disqualified. A winner entering via an alternative method of entry will be notified via telephone. If a potential winner is not available for the phone call, no messages will be left. Red Diamond will make at least one (1) attempt to reach a potential winner via telephone within three (3) business days, and if Red Diamond does not reach the potential winner, he/she will be disqualified. If any potential winner is disqualified for any reason (including because the winner is not eligible to participate), an alternate winner will be selected. This process will continue until a winner has been selected and notified and the winner’s eligibility is confirmed. Red Diamond reserves the right to modify prize award procedures.
Automatic Disqualification: In addition to the disqualification described above, any of the following actions by an entrant will result in the entrant’s automatic disqualification from the Sweepstakes: 1) tampering with the Sweepstakes in any way; or 2) failure to comply with these Official Rules; or 3) any other act which Red Diamond determines in its sole discretion negatively affects the integrity of the Sweepstakes.
General Terms and Conditions: Red Diamond reserves the right to cancel or modify this Sweepstakes if the integrity or proper conduct of the Sweepstakes is impaired due to factors beyond its reasonable control. Red Diamond reserves the right, but will have no obligation, to choose a winner from among eligible entries received prior to the occurrence of the impairment.
Release: By entering the Sweepstakes, you agree that Red Diamond and its shareholders, members, officers, directors, agents, representatives, and employees (“Releasees”) shall not be liable for any injuries, losses, damages, claims, actions or any liability of any kind arising from or relating to, in whole or in part, directly or indirectly, participation in the Sweepstakes or acceptance, possession, use, misuse, or nonuse of the prizes awarded.
Governing Law / Disputes: Sweepstakes and Official Rules shall be interpreted in accordance with the laws of the State of Alabama, without regard to its principles of conflicts of law, and applicable federal law. Jurisdiction and venue shall be solely within the State of Alabama. No Releasee shall be responsible for errors, including its own, relating to the Sweepstakes or for lost, stolen, misdirected, misdelivered, late, incomplete, or inaccurate entries. Except where prohibited by law, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of a winner shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances will an entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, and the entrant further waives all rights to have damages multiplied or increased.
